Is the Appointments Clause satisfied (also discussed in an odd law review article a few years back) with preliminary decisions by ALJs? Is due process offended by rocket docket - maybe they call it streamlined - case management?Is it a problem to give Chevron deference to ALJ preliminary decisions that become final agency decisions?Is there an improper home court advantage when the SEC wins 100% of the time in front of its ALJs and only 7/12 cases in big boy courts?
